FCC Postpones 'No Fax' Rule

A new rule by the Federal Communications Commission will prohibit the unsolicited faxed advertisement of goods or services by businesses (and nonprofit associations) to their clients or members. The compliance deadline has been pushed back from Aug. 25 to Jan. 1, 2005 after many trade associations argued that the rule is unnecessary and overly burdensome to businesses.

The rule does not cover routine faxes to clients in the course of daily business involving the collection of forms, client data or legal agreements. Only unsolicited advertisements are prohibited under the rule; it does not affect e-mail communications. In order to send such faxes, you will need a client's written consent to receive faxed advertisements from your firm, including the fax number. To review the discussion of the FCC's new rule, please go to page 109.

The CFP Board Announces Significant Changes

February 19, 2003 - The CFP Board announced significant changes to disclosure requirements under the Code of  Ethics and Professional Responsibility, primarily for CFP® certificants involved in a financial planning engagement. The changes took effect on January 1, 2003. The CFP Board also added two new definitions, "compensation" and "financial planning engagement," and amended the definition of "conflicts of interest" under the terminology section of the Code. In addition, the CFP Board revised its interpretation of "fee-only" in the terminology section by replacing two earlier advisory opinions with a new one, Advisory Opinion 2003-1, that more narrowly defines the application of "fee-only" in advertisements and disclosures to existing and prospective clients. The new advisory opinion in effect generally prohibits CFP® professionals from using the term "fee-only" with clients or in advertisements if they receive third-party commission or referral compensation.

These changes may be found on the CFP Board's web site at http://www.cfp.net/certificants/boardreport.aspWe strongly encourage you to become aware of the new changes that affect not only CFP certificants, but all FPA members inasmuch as they are subject to the principles of the Code of Ethics as well.
